Libel 一词源自拉丁语liber(书)的指小词libellus(小书、小册子;申诉书、书面控告、投诉),14世纪经古法语libelle(小书;指控、索赔;令状;书面报告)进入英语。最初原是用来表示“正式的书面声明、任何类型的书面材料”,特别是曾用来表示攻击人的书面材料,即古代权贵要人们四处散发用来控诉、揭短或诽谤对手的“传单、小册子”。从控诉的概念出发, libel 后来引申指海事法、教会法以及苏格兰法中的“原告诉状”。从诽谤的概念出发, libel 则发展出现在的主要含义指“诽谤性文字、图画等”,以及在法律领域表示“诽谤(罪)”,与 slander (口头诽谤;口头诽谤罪)相对,
