Libel 一词源自拉丁语liber（书）的指小词libellus（小书、小册子；申诉书、书面控告、投诉），14世纪经古法语libelle（小书；指控、索赔；令状；书面报告）进入英语。最初原是用来表示“正式的书面声明、任何类型的书面材料”，特别是曾用来表示攻击人的书面材料，即古代权贵要人们四处散发用来控诉、揭短或诽谤对手的“传单、小册子”。从控诉的概念出发， libel 后来引申指海事法、教会法以及苏格兰法中的“原告诉状”。从诽谤的概念出发， libel 则发展出现在的主要含义指“诽谤性文字、图画等”，以及在法律领域表示“诽谤（罪）”，与 slander （口头诽谤；口头诽谤罪）相对，
